More people are searching for rentals from outside Italy than ever before, and with that has come a noticeable rise in scams, misleading listings, and contracts that can’t support residency. While there are absolutely excellent properties, owners, and agencies out there, there are also situations where things aren’t what they seem. My goal in this episode is to help you understand the current landscape so you can rent safely and confidently.

I walk through the most common issues I’m seeing: listings that look legitimate but don’t exist, owners who aren’t legally authorized to rent, properties that can’t be used for residency, and contracts that fall outside the protections of Italian law. I also explain why certain contract types — like transitorio, 3+2, and 4+4 — offer real legal security, and why anything outside of those structures can put you at risk.

I share examples of what’s going wrong for people right now, especially renters searching from abroad who are relying on photos alone, skipping contract registration, or trusting AI tools to review legal documents. These are simple mistakes, but they’re costing people money, time, and in some cases, their ability to secure residency.

But if you actually want to live here and work in that business, that’s where visas come into play. There’s a big difference between forming a company on paper and being legally allowed to work inside it. I walk you through that distinction in a really simple way.

From there, I outline the main paths toward citizenship. Marriage to an Italian citizen can shorten the timeline to as little as two years of residency. On today’s show, I’m unpacking a landmark court ruling that could completely change how families apply for one of Italy’s most challenging visas—the Elective Residency Visa (ERV).

Here’s the big news: For years, consulates (especially in the US and UK) have insisted that each adult applying under the ERV prove their own independent passive income of over €31,000 per year. So if you were a couple? That meant €62,000 total—and from separate sources.

But a recent ruling by the Regional Administrative Court in Lazio just struck that down. A British couple who were denied their visa in 2022 because they applied jointly—using shared income—just won their case. And the implications are huge.

In this episode, I explain:

• What the court actually said (and why it matters)
• The real income thresholds families now need to meet
• What this means for couples who applied before—and got denied
• What we still don’t know (yet) about how this applies if one spouse has no income
• Why this is about more than money—it’s about how Italy defines family

If you’ve been told “no” before because your income was shared, or you were applying as a couple—this could be your chance to reapply, with the law now on your side.

I’ll break down what qualifies as a family member in Italy’s eyes (spoiler: you need to be legally married or in a registered civil union—common-law relationships don’t count here). And I’ll explain the difference between bringing children versus bringing a spouse, especially now that Italy has introduced a two-year wait for spouses under family cohesion. Yep, that’s new—and not great—but there is a workaround.

I’ll walk you through the steps you need to follow, like:

• Getting your own Digital Nomad Visa approved first
• Securing a long-term lease in Italy
• Applying for the Nulla Osta (a critical clearance document)
• And gathering all the paperwork—like marriage certificates, birth certificates, and apostilles—that you’ll need to submit on your family’s behalf

I break down the two main reasons people take their citizenship cases to court: the 1948 rule and what’s known as the "no appointment" case. The 1948 rule applies if you have a female ancestor who couldn’t pass on her citizenship before January 1, 1948, due to outdated laws. If that’s your situation, applying through the consulate will almost always lead to rejection, leaving the court as your only option. The "no appointment" case, on the other hand, is for those stuck in limbo with wait times so long at their consulate that they’re forced to ask the courts to step in and take jurisdiction.

To help make sense of it all, I’m joined by Terry Wilson, our head citizenship expert. Terry breaks down the ins and outs of the court process, including the documents you’ll need and what to expect in terms of timelines—usually 18 months to two years. While it might sound intimidating, Terry explains how the court route is often faster and less frustrating than dealing with the consulate, especially if you’re applying with multiple family members and can share the costs.

We also dive into the many benefits of pursuing citizenship through the courts. You don’t need to appear in court yourself, you can include your entire family in one petition, and well-prepared cases typically have very favorable outcomes. Today, Ferragosto remains a cherished time for Italians to take a break, reconnect with family and friends, and enjoy festivities. Many businesses close, especially in smaller towns, but tourist areas and larger cities like Rome, Florence, and Milan remain lively.

Please note that since Law 74/2025 went into effect on May 24, 2025, eligibility for the comune case (also known as the fast-track route) has been immediately affected.

You can now only pursue the fast-track process if you have an Italy-born parent or grandparent who did not naturalize.

If your Italy-born parent or grandparent did naturalize, your case would instead fall under citizenship by naturalization, which requires uninterrupted legal Italian residency for two years before applying. To do so, you must first obtain a visa and residence permit.

We’ve added helpful links at the bottom of these show notes so you can learn more and assess your eligibility under the new law. If there are any changes or updates to this law, our team will report on them and share what they mean for future applicants.

Italian citizenship is not just about connecting with your heritage; it's a gateway to European living, granting you the freedom to live, work, or study in any EU country. However, the journey to citizenship can be long and complex, with some applicants facing years-long waits at local consulates or even having to petition Italian courts.

But there's a faster way: the fast track application in Italy. While it promises a quicker path to citizenship, it comes with its own set of challenges and requirements, which we'll explore in detail.

Qualifications for Fast Track Citizenship

To qualify for fast track citizenship, you must have an Italian ancestor who did not naturalize as a citizen of another country before their child (your direct ancestor) was born.

Preparing for the Application

Before you pack your bags for Italy, your application must be complete. This includes gathering extensive documentation, such as vital records, apostilles, and translations, which must be sworn in an Italian court. Arriving in Italy with an incomplete application can result in being turned away.

Residency in Italy

A critical aspect of the fast track process is that you must move to Italy and establish residency there. This means finding a place to live and transferring your fiscal residence to Italy. It's not enough to visit for a short period; you must be a resident to apply.

Timing and Costs

The process can take anywhere from four months to a year, depending on where you apply. Costs vary, but a full legal review of your application is essential and can start around 650 euros. Professional assistance is recommended, with services like ours starting at around 3,000 euros.

Bringing Your Spouse

If you're married, your spouse can join you in Italy without a visa, provided you're legally married and have suitable accommodation. They can apply for a permesso di soggiorno (residence permit) based on your application.

Choosing where to apply is crucial. Smaller towns may offer a faster process, while larger cities can be slower as they are busier.

The private system is pay-as-you-go and can be a good option for those who are generally healthy and don't require frequent medical attention.

Cultural differences in approaching health and medicine are also significant. Italians take their health seriously, and there's a cultural permission to be sick and take the time to recover without fear of repercussions at work.

In today's episode, I am tackling the intricacies of the Elective Residency Visa (ERV), a topic that's both my specialty and a common source of confusion for many aspiring expats.

The ERV is Italy's invitation to those who can support themselves without working in the country. It's perfect for retirees or anyone with a steady stream of passive income. However, it's not a one-size-fits-all solution, and it's certainly not for those looking to work or start a business in Italy.

I focus on two major qualifications for the ERV: securing a residential address in Italy and meeting the financial requirements. Finding a rental can be a challenge due to Italy's tenant-friendly laws, so I recommend starting your search two to three months before your planned move and considering the help of a rental agency.

When it comes to finances, the key term is "substantial passive income." While consulates often state a minimum of 32,000 euros per person annually, I've found that aiming for over 45,000 euros net per person per year is a safer bet for approval. Remember, passive income should be regular, reliable, and guaranteed—think pensions and investment income, not savings or 401ks.

A well-crafted cover letter is your secret weapon. It should convey your preparedness for the move, your understanding of immigration obligations, and your financial stability. And if you don't qualify for the ERV, don't lose hope—there are other visas, like the investor visa, that might be a better fit.

If you're on the fence about applying, I say go for it. Even if you're denied, you can always reapply if your situation improves. Just make sure you have a Plan B and don't make any irreversible decisions until your visa is approved.
